Acceptable Use Policy

1.PURPOSE

VICTORY DIGITAL MARKETING SOLUTIONS ("VDMS", “Company,” “we,” “us,” or “our”) is committed to maintaining the highest level of platform integrity, performance, and deliverability for all users.

This Acceptable Use Policy (“AUP”) outlines prohibited activities and content when using our platform and services (the “Services”).

Violation of this policy may result in:

  • Immediate suspension

  • Account termination without notice

2. PROHIBITED CONTENT

You may NOT use Victory Digital Marketing Solutions to create, promote, distribute, or store content that is illegal, harmful, deceptive, or likely to damage platform reputation or deliverability.

2.1 Illegal or Regulated Content

  • Illegal goods or services

  • Activities that violate local, state, federal, or international laws

  • Sale or promotion of drugs or controlled substances

  • Unauthorized or unlicensed financial services

2.2 Deceptive & Misleading Offers

  • False or misleading business opportunities

  • “Get rich quick” schemes or guaranteed income claims

  • Pyramid schemes or multi-level marketing scams

  • Misleading or unsubstantiated advertising claims

2.3 Adult & Explicit Content

  • Pornography or sexually explicit material

  • Escort services or adult dating services

  • Sexually suggestive or exploitative content

2.4 Restricted / High-Risk Industries

  • Gambling or sports betting

  • Cryptocurrency schemes or speculative trading offers

  • Forex bots, stock signals, or automated trading systems

  • Cannabis or marijuana-related products/services (where restricted)

  • Pharmaceutical or supplement products with unverified claims

2.5 Harmful or Offensive Content

  • Hate speech or discriminatory content

  • Content promoting violence, abuse, or exploitation

  • Human trafficking, child exploitation, or animal abuse

  • Graphic or disturbing imagery

2.6 Spam & Low-Quality Content

  • Bulk unsolicited messaging (email, SMS, or other channels)

  • Content likely to be flagged by spam filters

  • “Solo ads” or sending promotions for multiple businesses to one list

  • Artificial engagement (fake followers, likes, or traffic)

3. CONTENT SUBJECT TO REVIEW

The following industries and practices are not strictly prohibited, but are considered high-risk and may result in account review, restricted usage, or termination if they negatively impact platform performance:

  • Financial services (loans, credit repair, mortgages)

  • Investment or trading education/services

  • Cryptocurrency or digital asset promotions

  • Affiliate marketing at scale

  • Adult novelty products

  • Third-party messaging services or “done-for-you” outbound campaigns

We reserve the right to limit or suspend accounts engaged in these activities.

4. PROHIBITED ACTIONS

You may NOT use the Services in connection with any of the following activities:

4.1 Data & Lead Violations

  • Purchasing, renting, or scraping contact lists

  • Harvesting leads from websites, directories, or social platforms

  • Uploading contacts without proper consent

  • Violating TCPA, CAN-SPAM, or other communication laws

👉 All leads must be obtained through clear, voluntary opt-in.

4.2 Messaging Abuse

  • Sending unsolicited SMS, email, or automated messages

  • Ignoring opt-out or unsubscribe requests

  • Misrepresenting sender identity

  • Excessive messaging that leads to complaints or spam reports

4.3 Platform Abuse

  • Attempting to hack, exploit, or reverse engineer the platform

  • Using bots, scripts, or automation beyond normal human usage

  • Overloading or disrupting system performance

  • Unauthorized access to accounts or data

4.4 Malware & Security Threats

  • Uploading or distributing malicious code

  • Using spyware, ransomware, or tracking exploits

  • Attempting to compromise system security

4.5 Affiliate & Marketing Abuse

  • Cookie stuffing or injection

  • Spam posting in forums or social platforms

  • Automated or deceptive affiliate promotion tactics

4.6 AI Misuse

  • Using AI tools to generate illegal, harmful, or deceptive content

  • Creating spam at scale using automation

  • Attempting to manipulate or exploit AI systems (“jailbreaking”)

  • Using AI in ways that violate laws or ethical standards

5. SMS & COMMUNICATION COMPLIANCE

If you use our platform for messaging:

You MUST:

  • Obtain express written consent before contacting individuals

  • Provide clear opt-out instructions

  • Honor opt-outs immediately

  • Comply with all applicable laws (TCPA, CAN-SPAM, etc.)

Failure to comply may result in:

  • Immediate account suspension

  • Carrier reporting

  • Legal exposure

6. ENFORCEMENT & MONITORING

We reserve the right to:

  • Monitor usage and messaging activity

  • Investigate suspected violations

  • Remove content without notice

  • Suspend or terminate accounts at our sole discretion

We may also report violations to:

  • Law enforcement

  • Regulatory agencies

  • Third-party providers

7. DELIVERABILITY & PLATFORM PROTECTION

To protect all users:

  • Accounts that generate high complaint rates, spam flags, or abuse signals may be restricted

  • Messaging limits may be applied

  • Sending capabilities may be suspended

Our priority is maintaining high deliverability and platform reputation.
